Adding to the legal responsibilities is the Corporate Manslaughter and Corporate Homicide Act 2007 which came in force on the 6th of April 2008 and the Health and Safety (Offences) Act 2008 which came into force 16th January 2009 which applies to saftey breaches that do not result in death. 
The stricter penalties for road traffic offences could also have a detrimental effect on key staff members resulting in loss of licences or an encreased risk of prison sentences. With the encreasing legislation and high risks involved, driving for work needs to be effectively managed.  According to the Department For Transport, “work related road safety can effectively be managed only if it is inergrated into arrangements for managing health and safety at work. You should look at your health and safety systems and consider whether they adequately cover this area of work.”

These statistics create a real potential to effect you and your workforce as well as a duty of care challange if you are an employer with more than 5 drivers or self employed, as health and safety law applies to on the road work activities. 
As former Road Safety Minister, Jim Fitzpatrick pointed out.  “The yearly cost to industry of at work road accidents has been estimated at between £2.7 and £3.7 billion. There is no fleet size limit below which driver safety is not good business.  Employers have a legal responsibility for the safety of the staff, including employees on the move.”
